I. Acceptance of Terms
This BUNDLEOFJOYS.COM End-User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity Licensee) and BUNDLEOFJOYS.COM (BUNDLEOFJOYS.COM or Licensor) for the use of the software used with your BUNDLEOFJOYS.COM service, which includes computer Software, and may include associated media, printed materials, and "online" or electronic documentation, ("the SOFTWARE").
II. Use of Material
The contents of this Web Site, such as text, graphics, images, logos, button icons, software and other "Material", are protected under United States and foreign copyright, trademark and other laws. All Material is the property of the Company or its content suppliers or clients. The compilation (meaning the collection, arrangement and assembly) of all content on this Web Site is the exclusive property of the Company and protected by U.S. and international copyright laws. Unauthorized use of the Material may violate copyright, trademark, and other laws. You must retain all copyright, trademark, service mark and other proprietary notices contained in the original Material on any copy you make of the Material. You may not sell or modify the Material or reproduce, display, publicly perform, distribute, or otherwise use the Material in any way for any public or commercial purpose. The use of the Material on any other web site or in a networked computer environment for any purpose is prohibited. You shall not copy or adapt the HTML code that the Company creates to generate its pages. It is also protected by the Company's copyright.
Domain forwarding is unacceptable. If you do this at BUNDLEOFJOYS.COM, your site will be terminated without notice. This is domain spoofing. Domain forwarding is prohibited without expressed written permission from our BUNDLEOFJOYS.COM. Virtual domain referrals rob BUNDLEOFJOYS.COM of the right to determine a reasonable standard of care to protect our reputation in the internet community. We retain all rights to protect and defend our reputation against unscrupulous practices. If you hire one of these companies to deceive people into coming to your site on BUNDLEOFJOYS.COM. Your site is subject to termination for this behavior.
III. Acceptable Site Use
General Rules: Users may not use the Web Site in order to transmit, distribute, store or destroy material (a) in violation of any applicable law or regulation, (b) in a manner that will infringe the copyright, trademark, trade secret or other intellectual property rights of others or violate the privacy, publicity or other personal rights of others, or (c) that is defamatory, obscene, threatening, abusive or hateful.
Website Accounts: Users may have only one (1) free account and unlimited paid accounts per household or child. Users who abuse this policy will have their latest account(s) removed without notice.
IV. Rules for and Limitations on Use of Services
BUNDLEOFJOYS.COM may establish rules for and limitations on use of the Service. BUNDLEOFJOYS.COM reserves the right to change these rules and limitations at any time, in its sole discretion, with or without notice. BUNDLEOFJOYS.COM may modify or discontinue, temporarily or permanently, the Service (or any part thereof) and may remove content from the Service, with or without notice to you. BUNDLEOFJOYS.COM will not be liable to you or to any third party for any modification or discontinuance of the Service or removal of content from the Service. You may not reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the Service, use of the Service, or access to the Service. Information provided by BUNDLEOFJOYS.COM is not warranted to be accurate or complete, and will not constitute a warranty or representation by BUNDLEOFJOYS.COM.
V. Web Site Security Rules
Users are prohibited from violating or attempting to violate the security of the Web Site, including, without limitation, (a) accessing data not intended for such user or logging into a server or account which the user is not authorized to access, (b) attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization, (c) attempting to interfere with service to any user, host or network, including, without limitation, via means of submitting a virus to the Web Site, overloading, "flooding", "spamming", "mailbombing" or "crashing", (d) sending unsolicited e-mail, including promotions and/or advertising of products or services, or (e) forging any TCP/IP packet header or any part of the header information in any e-mail or newsgroup posting. Violations of system or network security may result in civil or criminal liability. The Company will investigate occurrences that may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations.
VI. User Submissions
As a user, you are responsible for your own communications and are responsible for the consequences of their posting. You must not, and by using this Web Site you agree not to do the following things: post material that is copyrighted, unless you are the copyright owner or have the permission of the copyright owner to post it; post material that infringes on any other intellectual property rights of others or on the privacy or publicity rights of others; post material that is obscene, defamatory, threatening, harassing, abusive, hateful, or embarrassing to another user or any other person or entity; post a sexually-explicit image or statement; post advertisements or solicitations of business, post chain letters or pyramid schemes; impersonate another person; or post material that contains viruses, Trojan horses, worms, time bombs, cancelbots or other computer programming routines or engines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or information; or post material that is irrelevant to the website and its context.
The Company does not represent or guarantee the truthfulness, accuracy, or reliability of communications posted by users or endorse any opinions expressed by users. The Company is not responsible for lost content due to user actions. You acknowledge that any reliance on material posted by other users will be at your own risk.
VII. Payments, Fees and Refunds
Users may choose to upgrade their free account by purchasing web space. Payments are made through PayPal using a PayPal account or any major credit card. By purchasing web space, you are signing up for a subscription of one full year for use of that space. After each term, your subscription is automatically renewed unless you cancel. There is a 7 day grace period in which you may receive a full refund if you cancel within this time after the auto-renewal. Partial refunds may be given within 30 days after renewal. No refunds will be given after this period. Users who have an inactive account according to section VIII of the Terms may choose to restore that account by paying a one-time fee per inactive account.
VIII. Termination
BUNDLEOFJOYS.COM, in its sole discretion, may terminate your use of the Service for any reason without prior notice including, without limitation: (i) if you have breached these Terms; (ii) if BUNDLEOFJOYS.COM is unable to verify or authenticate any information you have provided to BUNDLEOFJOYS.COM; (iii) if BUNDLEOFJOYS.COM believes that you have violated or acted inconsistently with the letter or spirit of the Terms; (iv) if any account remains inactive for 120 days or more; or (v) if BUNDLEOFJOYS.COM believes you are acting in an unethical manner by disorderly, rude or vulgar postings, emails or comments on other members sites. You acknowledge and agree that BUNDLEOFJOYS.COM may immediately deactivate or delete your user account and all related information and files in your user account and/or bar any further access to the Service. BUNDLEOFJOYS.COM will not be liable to you or any third-party for any termination of your access to the Service.
IX. Links
The Service may provide links to other World Wide Web sites or resources. BUNDLEOFJOYS.COM has no control over or responsibility for such sites and resources. You agree that BUNDLEOFJOYS.COM is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources. BUNDLEOFJOYS.COM provides these links to you only as a convenience and inclusion of any link does not imply endorsement of the site.
X. Limitation of Liability
YOU AGREE THAT BUNDLEOFJOYS.COM SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF BUNDLEOFJOYS.COM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SERVICE AND/OR THE SOFTWARE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM THE SERVICE AND/OR THE SOFTWARE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR ACCOUNT BY ANYONE OTHER THAN BUNDLEOFJOYS.COM; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, THEREFORE, SOME OF THE ABOVE LIMITATIONS OF SECTIONS 12 AND 13 MAY NOT APPLY TO YOU.
